{"id":9174,"date":"2024-06-24T11:09:52","date_gmt":"2024-06-24T10:09:52","guid":{"rendered":"http:\/\/www.invest-expat.com\/?p=9174"},"modified":"2024-06-24T11:09:52","modified_gmt":"2024-06-24T10:09:52","slug":"deveniez-lmp-savoir","status":"publish","type":"post","link":"https:\/\/peaceful-dubinsky.54-37-225-243.plesk.page\/index.php\/2024\/06\/24\/deveniez-lmp-savoir\/","title":{"rendered":"NON-RESIDENTS : ET SI VOUS DEVENIEZ LMP SANS LE SAVOIR ?"},"content":{"rendered":"<h2>La location meubl\u00e9e permet de b\u00e9n\u00e9ficier de revenus r\u00e9guliers plus importants qu\u2019en location nue et d\u2019une fiscalit\u00e9 plus avantageuse gr\u00e2ce \u00e0 la d\u00e9duction des amortissements.<\/h2>\n<p><!--more--><\/p>\n<p>Pour pouvoir b\u00e9n\u00e9ficier de la fiscalit\u00e9 de la location meubl\u00e9e, le logement doit\u00a0<u>comporter suffisamment de meubles<\/u>\u00a0pour que le locataire puisse y vivre avec ses seuls effets personnels.<\/p>\n<p><strong>Avant 2020, \u00e9taient consid\u00e9r\u00e9s comme professionnels les loueurs en meubl\u00e9 qui remplissaient les trois conditions suivantes :<\/strong><\/p>\n<ul>\n<li>un membre du foyer fiscal au moins est inscrit au RCS (Registre du Commerce et des Soci\u00e9t\u00e9s) en qualit\u00e9 de loueur professionnel<\/li>\n<li>les loyers per\u00e7us sont sup\u00e9rieurs \u00e0 23 000 \u20ac par an<\/li>\n<li>ces loyers sont sup\u00e9rieurs aux autres revenus professionnels du foyer fiscal (pensions de retraite comprises).<\/li>\n<\/ul>\n<p><strong>La condition d\u2019inscription au RCS ayant \u00e9t\u00e9 supprim\u00e9e, cela signifie que si vous percevez plus de 23 000 \u20ac annuels de loyers de vos locations meubl\u00e9es, et que ces loyers sont sup\u00e9rieurs \u00e0 vos autres revenus professionnels ou retraites, alors vous \u00eates\u00a0 un loueur professionnel aux yeux de l\u2019administration fiscale. En tant que non-r\u00e9sidents, comme vous ne d\u00e9clarez pas vos revenus professionnels en France, vous \u00eates plus susceptible de basculer au statut LMP.\u00a0<\/strong><\/p>\n<p><strong>Bonne ou mauvaise nouvelle ? <\/strong><\/p>\n<p>Ce statut peut vous permettre d\u2019imputer les d\u00e9ficits g\u00e9n\u00e9r\u00e9s par l\u2019activit\u00e9 de location meubl\u00e9e sur vos autres revenus. N\u00e9anmoins, les cons\u00e9quences en termes de plus-value \u00e0 la revente peuvent \u00eatre moins favorables qu\u2019en \u00e9tant loueur non professionnel.<\/p>\n<p><strong>Et au niveau social ? <\/strong><\/p>\n<p>Sur le plan social, l&rsquo;activit\u00e9 de location meubl\u00e9e exerc\u00e9e en direct (autrement dit : non exerc\u00e9e dans le cadre d\u2019une soci\u00e9t\u00e9) est trait\u00e9e diff\u00e9remment selon le type de location (r\u00e9sidence principale du locataire ou location saisonni\u00e8re) et le montant des recettes.<\/p>\n<p>Ainsi, deux possibilit\u00e9s :<\/p>\n<ul>\n<li>soit vos recettes sont assujetties aux pr\u00e9l\u00e8vements sociaux (au taux de 17.2 % actuellement)<\/li>\n<li>soit vos recettes sont soumises aux cotisations sociales<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 class=\"fd-document-box-title\"><span style=\"color: #ba0d4f\">Attention : Revenus 2024 &amp; location d&rsquo;un meubl\u00e9 de tourisme class\u00e9\/non class\u00e9<\/span><\/h3>\n<div class=\"fd-document-box-description\">\n<p><span style=\"color: #ba0d4f\">La loi de finances pour 2024 a revu la fiscalit\u00e9 applicable aux<u>\u00a0meubl\u00e9s de tourisme<\/u>.<\/span><br \/>\n<span style=\"color: #ba0d4f\">Pour les revenus per\u00e7us en 2024 et issus de la location d\u2019un\u00a0<u>meubl\u00e9 de tourisme non class\u00e9,\u00a0le seuil du micro-BIC est abaiss\u00e9 \u00e0 15\u00a0000 \u20ac<\/u>\u00a0(pour un abattement de 30 %).<\/span><\/p>\n<p><span style=\"color: #ba0d4f\"><u>Le franchissement du seuil, de 15\u00a0000 \u20ac,\u00a0<\/u>entraine automatiquement l\u2019imposition au \u00ab\u00a0r\u00e9el\u00a0BIC \u00bb des revenus. Le r\u00e9gime r\u00e9el implique la\u00a0<u>tenue d\u2019une comptabilit\u00e9 commerciale<\/u>\u00a0(comptabilit\u00e9 r\u00e9guli\u00e8re, sinc\u00e8re et appuy\u00e9e sur des pi\u00e8ces justificatives). Ainsi, le contribuable est susceptible de devoir\u00a0<u>reconstituer une comptabilit\u00e9<\/u>\u00a0s&rsquo;il d\u00e9pend du r\u00e9gime r\u00e9el d&rsquo;imposition.\u00a0<\/span><\/p>\n<p><span style=\"color: #ba0d4f\">Afin de conserver le r\u00e9gime micro-BIC, le contribuable peut faire classer son meubl\u00e9 de tourisme. Le seuil du micro-BIC \u00e9tant d\u00e8s lors de 188\u00a0700 \u20ac (pour un abattement de 71 % ou 92 %).<\/span><br \/>\n<span style=\"color: #ba0d4f\"><u>La demande de classement<\/u>\u00a0doit \u00eatre adress\u00e9e \u00e0 un organisme agr\u00e9\u00e9 ou accr\u00e9dit\u00e9 (liste disponible sur\u00a0<a href=\"https:\/\/www.classement.atout-france.fr\/le-classement-des-meubles-de-tourisme\">atout-france.fr<\/a>).
